2. SUBJECT AND SCOPE OF THE CONTRACT

  This distance sales contract has been drawn up in accordance with the law on consumer protection and the regulation on distance sales contracts. The subject of this contract is the BUYER's own belonging to the SELLER.www.sagrande.com.trPursuant to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts published in the Official Gazette dated 27.11.2014 and numbered 29188, regarding the sale and delivery of the product, the qualities and sales price of which are specified in this contract, in which Article 3 is ordered electronically from the website named . and determining its obligations.

  In case the order is approved, the BUYER is deemed to have accepted all the terms of this contract.

 

 

4. DELIVERY

 

  Delivery will be made by Sagrande via courier to the above-mentioned delivery address within 10 working days, in any case within the legal period of 30 days, after the order has been confirmed. Official holidays and religious/national holidays are not counted from this period. At the time of delivery, the Customer shall sign the delivery receipt after inspecting the product. By following this delivery note, the customer or the person acting on behalf of the customer will declare that he has received the product completely, completely and undamaged. 

 

  In extraordinary situations such as strikes, lockouts, natural disasters, uprisings, public movements, nuclear risk, and danger, war, invasion, revolution, civil war, sabotage and fire situations, discount periods and due to the buyer ( Delivery time and conditions may vary in case of not being present at the address, absence of an authorized person to receive the delivery, the buyer having moved from the address, etc.).

 

5. DELIVERY FROM STORE

  You can receive your product within 10 days from our store, which is specified only for the products you have purchased with the choice of delivery from the store. If the product is not received within the delivery period and the SELLER cannot be contacted, the order will be canceled after 30 days.

6. RIGHT OF WITHDRAWAL

 

  The consumer has the right to withdraw from the contract within 14 (fourteen) days without giving any reason and without paying any penal clause. The right of withdrawal period is the day the contract is established in contracts regarding service performance; In contracts for the delivery of goods, it starts on the day the consumer or the third party determined by the consumer receives the goods. However, the consumer may use the right of withdrawal within the period from the conclusion of the contract to the delivery of the goods.

 

  In determining the right of withdrawal; a) The day on which the consumer or the third party determined by the consumer receives the final product in goods that are the subject of a single order and delivered separately, In contracts where the goods are delivered regularly throughout the period, the day the consumer or the third party determined by the consumer receives the first goods is taken as a basis. 

 

  In the contracts where the delivery of goods and the performance of services are made together, the provisions of the right of withdrawal regarding the delivery of goods are applied. 

 

  It is sufficient to manage the notification that the right of withdrawal has been exercised, in writing and with a permanent data storage, before the right of withdrawal expires. In exercising the right of withdrawal, the consumer may make a clear statement of his decision. The consumer using the right of withdrawal has to return the product to the seller within 10 days. If the right of withdrawal is not exercised in due time, the consumer will lose this right. 

 

7. PROVISIONS REGARDING THE USE OF THE RIGHT OF WITHDRAWAL AND RETURN OF THE PRODUCT

 

  7.1 Products without prepaid and boxed products cannot be returned.

  7.2 Returns of products whose original packaging is damaged, which have lost their resaleability and cannot be purchased by another customer are not accepted. All labels of the product to be returned must be on the product and must not be modified. 

  7.3 You must send all your copies, the original invoice and your return tracking number along with the product you want to return. Returns will not be accepted on non-prepaid products.

  7.4 The shipping fee for the products you want to return is covered by the customer (buyer)

  7.5 Wedding dresses, evening dresses and personalized products cannot be returned or exchanged.

  7.6 Your products are sent to you with the delivery note and return form . In the return form, you must specify the barcodes of the products you want to return and the reason for the return. 

 

  7.7 When returning your product, the return form should be filled and the packing slip should be placed in the cargo package. 

 

  7.8The incoming product is first reviewed by SAGRANDE. If it meets the above conditions, the return process is started. 

When the return process is approved, the buyer is informed by sending an e-mail with the subject of YOUR RETURN REQUEST APPROVED. After this notification, the product fee will be refunded to your credit card within 14 days (fourteen) which is the legal period. 

  7.9 The buyer can return the product at the Sagrande store if he wishes. In case of return from the store, the price of the product is SAGRANDE TEKSTİL SANAYİ VE TİCARET LTD. STI. It is returned to the buyer's credit card by the business within 10 business days of the legal period. If the buyer wishes, he can get a return receipt for the price of the product. 

  7.10 The buyer can exchange the purchased product at the SAGRANDE store if the product range is suitable. 

  7.11Products purchased from the store belonging to the Sagrande organization cannot be changed or returned from the sagrande online shop. 

 

8. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL 

  The Customer cannot exercise its right of withdrawal in contracts for the delivery of any of the following products:

    A) Contracts for goods prepared in line with the consumer's wishes and personal needs.

    B) Goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; Contracts for the delivery of those whose return is unsuitable in terms of health and hygiene.

    C) Contracts for goods that are mixed with other products after delivery and cannot be separated due to their nature._cc781905-5cde-3194-bb3b-58_bad5cf

    d) Contracts for books, digital content and computer consumables presented in material form if protective elements such as packaging, tape, seal, package are opened after the delivery of the goods . 

    D) Contracts regarding the services that are started to be approved and performed by the consumer before the expiry of the right of withdrawal.

 

9. OTHER PROVISIONS

  9.1This contract has been created under the rules of Turkish law, and its validity and binding will be within the framework of the rules of Turkish law. Bursa courts will be authorized in any dispute arising from the implementation of this contract. Applications for complaints and objections are authorized by consumer arbitration committees within the monetary limits determined by the Ministry of Customs and Trade every year in December, and in cases exceeding the consumer courts and enforcement offices in the SELLER's residence. 

  9.2 The parties have the obligation to notify their new notification addresses in writing by registered letter with return receipt, expressly stating that they are related to the address change, in case the addresses they specified at the time of signing this contract change. Otherwise, notifications made to the old address will be deemed to be valid. 

  9.3 The information given in this agreement is given for commercial purposes in accordance with the distance communication tools used and within the framework of good faith principles, in a way to protect minors and adults who lack the power of discrimination or have limited power._cc781905-5cde-3194-bb3b-136435cf58d_

 

10. BUYER'S STATEMENT 

  The BUYER declares that he has read and possessed the preliminary information in this contract, including all information regarding the basic characteristics, sales price, payment method and delivery of the product subject to the contract, and has given the necessary confirmation in electronic environment.

 

11. PLACE AND DATE OF SIGNATURE 

  İThis Distance Sales Contract has been concluded electronically on the 'date and time of the sale' and a copy of it has been sent to the Buyer in electronic format to the e-mail address specified in Article 1 of this contract.
